MERCURY and APOLLO BUYER’S RESPONSIBILITY
With guidance from the Watson Service team, the buyer agrees to perform basic troubleshooting tasks to determine the nature of the defect and make attempts to self-correct before Watson personnel will provide on-site assistance. If the issue requires on-site assistance from Watson personnel and the product failure or defect is found to have resulted from items outside the warranty coverage, the buyer agrees to reimburse Watson for applicable expenses resulting from the claim. Expenses include, but are not limited to product shipping, installation labor, transportation, and accommodations. Watson reserves the right to request that the damaged product be returned prior to granting a remedy. Repairs, substitute products or replacements of equal or higher value used to resolve a warranty claim will in no way extend the warranty period applied to the original product. Warranty excludes product used beyond its intended purpose. This warranty could be voided if the end-user fails to adhere to Watson’s recommended cleaning guidelines.
Limits of Liability
Watson shall not be liable for loss of time, inconvenience, commercial loss, breach of contract, incidental or consequential damages.
Watson partners proudly with seating manufacturers such as Sedus, Via, and Concept Seating. The original manufacturer’s warranty will apply to sales of these products.
Watson makes no express of implied warranties as to any product, and in particular makes no warranty of fitness for any particular product, except for use as standard office furniture or in the case of Mercury and Apollo, as standard communication console furniture. Product repair or replacement is the customer’s exclusive remedy for any and all product defects.
Watson Non-Obsolescence Policy
Watson will make a good faith effort to maintain product compatibility within our various generations of product platforms to provide our customers with spaces that adapt to change. Watson’s non-obsolescence policy commits to providing our customers with products of comparable function or operational characteristics for a term equal to the warranty period. Watson fabrics and finishes must be updated periodically to maintain the market appeal of our products and respond to the demands and changing preferences of our customers. As a result, some fabrics and finishes are periodically discontinued. Other times vendors will discontinue an item that we have in our legacy products. When that happens, we will do our best to provide a suitable alternative from available inventory or suitable alternates.
